Terms and Conditions
1. Introduction
89 Transfers is a commercial service provided by Ramon Asen Pons Miralles, located at Carrer d'Eusebi Estada, 29, 8ºA, Norte, 07004 Palma, Mallorca, Balearic Islands, Spain (Tax ID/NIF 43208755N, REAT authorization VDE No. 12363393, sole trader).
These Terms of Service ("Terms") govern your use of our private transfer services in Mallorca. By using our services, you agree to these Terms. If you disagree, please do not use our services.
The version of these Terms applicable to your booking is the one published on our website at the time your reservation is confirmed. Please ensure you are reading the most current version.
2. Service Description
89 Transfers provides private overland passenger transportation services in Mallorca under a VDE authorization for discretionary passenger transport, in compliance with the Spanish Land Transport Organization Act (LOTT), including mandatory driving-time limits and rest periods for drivers to ensure safety. Services may also be provided through authorized collaborating operators (see Section 3).
Our services include:
- Airport transfers to and from Palma de Mallorca Airport (PMI)
- Port transfers to and from the Port of Palma
- Private transfers between any locations within Mallorca
- Other passenger transportation needs around the island
We operate exclusively within Mallorca and do not offer inter-island or international transfers.
3. Collaborating Operators and Service Delivery
3.1. 89 Transfers is your sole contractual counterparty and remains fully responsible to you for the proper performance of the service, regardless of which operator physically provides the transport.
3.2. While 89 Transfers directly operates services using its own authorized vehicle(s), certain services — particularly during peak seasons, for specific vehicle types (e.g., minivan, sedan, large group transport), or due to operational requirements — may be carried out by independent collaborating operators who hold their own valid transport authorizations (VDE, VTC, or other applicable license) under Spanish law.
3.3. Regardless of which operator carries out the transport, you will always receive the driver's name and contact details before the service. 89 Transfers remains your sole point of contact at all times.
3.4. All collaborating operators are contractually required to comply with these Terms of Service, including the same standards of quality, punctuality, vehicle condition, safety, and customer service that apply to 89 Transfers' own operations.
3.5. Your rights under these Terms — including cancellation, refund, waiting time, luggage, child seat policies, and dispute resolution — apply in full regardless of whether the service is provided directly by 89 Transfers or by a collaborating operator.
3.6. If you have concerns about the service provided by a collaborating operator, you should contact 89 Transfers directly (not the collaborator) using the contact details in your booking confirmation. We will handle all complaints and claims on your behalf.
4. Booking and Reservations
4.1. All services require a prior reservation, which can be made online through our website, via our mobile app, by phone (+34 871 15 36 69), by WhatsApp (+34 871 15 36 69), or by email ([email protected]).
4.2. The principal party making the reservation must be at least 18 years old and is considered to be acting on behalf of all passengers in the booking.
4.3. Upon successful booking, you will receive a confirmation by email. Please check your spam or junk folders if you do not receive it.
4.4. The information provided during booking (name, contact details, flight information, etc.) will be treated in accordance with our Privacy Policy and applicable data protection laws (GDPR, Spanish Organic Law 3/2018).
4.5. If we cannot confirm your reservation due to unavailability or other reasons, we will notify you promptly and offer alternative options or a full refund of any prepaid amounts.
4.6. It is your responsibility to provide complete and correct addresses, flight details, and contact information at the time of booking.
4.7. For low deposit bookings, the balance will be automatically deducted 7 days before the service date. If canceled 8 days or more before the service, the balance will not be charged, but the deposit is non-refundable.
5. Payment and Pricing
5.1. Payment is accepted through the following methods:
- Online payment by credit or debit card during the booking process
- Cash (€) directly to the driver at the time of service
- Card payment (Visa, Mastercard, etc.) directly to the driver at the time of service
The available payment options will be specified during the booking process.
5.2. Our prices are fixed and transparent. The price confirmed during your booking is the final price, unless you request changes (e.g., additional stops not pre-booked, extended waiting time beyond the included allowance). We reserve the right to change our prices, but changes will not affect existing confirmed bookings.
5.3. For certain services, including night services, we may require advance payment to confirm the booking.
5.4. In such cases, we will send a payment link or other secure payment instructions to the email address provided during booking.
5.5. The "Pay Later" option allows you to reserve a transfer without immediate payment. However, you must pay the full amount at the time of service. Failure to pay may result in debt collection proceedings and being barred from future bookings.
5.6. You declare that any credit or debit card used for payment is in your name and has sufficient funds to cover the cost of the service.
6. Cancellation Policy
6.1. Free Cancellation Period: Cancellations made more than 24 hours before the scheduled pickup time are free of charge, and any prepaid amount will be refunded — except for non-refundable deposits on low-deposit bookings, which are governed by section 4.7.
6.2. Late Cancellation Charges: Cancellations made within 24 hours of the scheduled pickup time will incur a 100% charge of the total booking price. No refund will be issued for prepaid services, and the full amount will be due for services booked with payment at completion.
6.3. How to Cancel: Cancellations must be made by email to [email protected], clearly referencing the booking ID and name of the person who made the booking.
6.4. Refunds: For eligible cancellations, refunds will be processed to the original payment method within 5–10 business days.
6.5. Airport Pickups and Flight Delays:
- We actively monitor all incoming flights to Palma de Mallorca Airport.
- We provide up to 1 hour of complimentary waiting time after the actual landing time of your flight for luggage collection and meeting the driver.
- If your flight is delayed, an additional grace period equal to the delay will be added, up to a combined maximum of 2 hours from the actual landing time. For example:
- a) Flight lands on time: 1 hour of complimentary waiting from actual landing.
- b) Flight delayed by 40 minutes: complimentary waiting extends to 1 hour 40 minutes from actual landing.
- c) Flight delayed by 1 hour or more: maximum complimentary waiting is 2 hours from actual landing.
- Passengers are responsible for informing us of significant delays or flight number changes when possible, especially if the flight is diverted or rescheduled.
- For waiting time exceeding the complimentary period described above, additional charges of €60 per hour will apply, billed proportionally (e.g., 30 minutes = €30). A rebooking may be necessary subject to driver availability.
6.6. Airline Flight Cancellations:
6.6.1. If the airline cancels your flight and 89 Transfers is notified more than 24 hours in advance by email, phone, or WhatsApp, the reservation can be cancelled or modified at no cost.
6.6.2. If the airline cancels your flight with less than 24 hours' notice, the standard late cancellation policy (6.2) applies. However, we will offer you the option to modify your reservation for an alternative date or time at no additional charge, subject to availability. We recommend passengers claim compensation directly from their airline under EU Regulation 261/2004, which provides for compensation between €250 and €600 depending on flight distance.
6.7. Late Cancellations for "Pay Later" Bookings:
- For bookings made with the "Pay Later" option, cancellations made within 24 hours of the scheduled pickup time will still require full payment for the service.
- Failure to pay for late cancellations may result in: a) The outstanding amount being due immediately and subject to our debt collection process (judicial or extrajudicial). b) 89 Transfers refusing to accept future bookings from the same client.
6.8. Special Circumstances: For bookings made during major events, holidays, or peak seasons, special cancellation policies may apply and will be clearly communicated at the time of booking.
6.9. Cancellations by 89 Transfers:
6.9.1. We strive to maintain all bookings and minimize disruptions. We work with trusted partners and collaborating operators (see Section 3) to ensure service continuity.
6.9.2. In rare or unforeseen circumstances where we must cancel the service (e.g., force majeure, vehicle breakdown):
- We will notify you as soon as possible via email and/or phone.
- Any amount paid will be refunded in full within 5–10 business days.
- We will make reasonable efforts to help arrange alternative transport, potentially through trusted partners, although this cannot be guaranteed.
6.10. Failure to Locate the Driver:
6.10.1. If you cannot find the driver at the designated meeting point or pickup location:
- Please wait a few minutes, as minor delays may occur.
- You must contact us immediately via phone or WhatsApp (+34 871 15 36 69) using the contact information provided in your booking confirmation. Do not leave the meeting point without contacting us.
6.10.2. If we are unable to establish contact with you and confirm your presence within a reasonable period (typically 1 hour after landing for airport pickups, or 15–20 minutes after the scheduled time for other locations), and it is determined that you were not present or did not attempt to contact us:
- No refund will be issued if you have already paid for the service.
- If you have not paid, you will still be required to pay the full service amount (considered a no-show).
6.10.3. To verify driver presence, our drivers use GPS positioning and may document their arrival and waiting time through timestamped records. The processing of this data is described in Section 12.2. We will thoroughly investigate any disputes, considering all available evidence from both parties before making a final decision.
6.11. External Service Disruptions:
In certain situations beyond the direct control or fault of either the passenger or 89 Transfers, the service may be significantly hindered or become impossible to complete as originally planned. Examples include, but are not limited to: extreme airport baggage-handling delays that significantly prevent the passenger from using the allocated waiting time, major sudden and unannounced road closures preventing access to pickup/drop-off points, or severe unforeseen traffic disruptions unrelated to normal conditions.
In such cases, both parties agree to communicate promptly and make reasonable efforts to find a mutually acceptable solution, which may include:
- Adjusting the pickup/drop-off point to the nearest accessible location.
- Rescheduling the service for a later time/date, subject to availability (additional charges may apply if service parameters change significantly).
- Modifying the service route if feasible.
If no reasonable solution can be found and the service cannot be performed due to such external disruptions:
- If the service has not commenced, any prepaid amount may be refunded in full or in part, or retained as credit, at the discretion of 89 Transfers, taking into account costs already incurred (e.g., driver dispatched).
- If the service has been partially completed, charges may be applied proportionally to the service rendered.
This clause is distinct from standard cancellations (6.1–6.4), no-shows (6.10), flight delays/cancellations (6.5–6.6), or Force Majeure events (Section 19), and applies specifically to unforeseen external factors directly affecting service execution at the time it is to be performed.
7. Meeting Points
7.1. Airport Pickups (Palma de Mallorca Airport — PMI):
7.1.1. The default meeting point for airport pickups is between columns 3 & 4 at the arrivals terminal, in front of Paul Express Coffee Shop.
7.1.2. If the driver has established communication with the customer and agreed on another location, that location will become the official meeting point.
7.1.3. The driver will carry a name sign with the booking name and will always maintain a position that facilitates easy visibility.
7.2. Port Pickups (Port of Palma):
7.2.1. The default meeting point for port pickups is at the exit of the Maritime Terminal where your cruise or ferry has docked.

7.4. Other Locations:
7.4.1. For pickups at other locations or addresses, the meeting point will be the one provided in the booking or in the "message for driver or staff" details.
7.4.2. If the instructions are unclear or cannot be met, the procedures specified in section 6.10 will apply.
7.5. Customer Responsibility:
7.5.1. Customers are responsible for being at the designated meeting point at the agreed time.
7.5.2. If a customer cannot locate the driver, they must follow the procedure outlined in section 6.10.
7.6. Driver Responsibility:
7.6.1. Drivers will make every effort to be visible and easily identifiable at the meeting point.
7.6.2. Drivers will attempt to contact the customer using the provided contact details if they cannot locate the customer after a reasonable waiting period.
7.7. Changes to Meeting Point:
7.7.1. Any changes to the meeting point must be communicated and confirmed in writing (via email, SMS, or WhatsApp) to avoid misunderstandings.
7.8. Waiting Time:
7.8.1. The waiting time policy as described in section 6.5 applies from the actual landing time at the designated meeting point for airport pickups, and from the scheduled pickup time for all other locations.
8. Luggage Policy
8.1. Standard Luggage Allowance:
Each passenger is allowed:
- a) One standard suitcase up to 23 kg
- b) One carry-on bag (dimensions as per current airline standards: typically 55 × 40 × 20 cm)
- c) One personal item (e.g., handbag, laptop bag, or small backpack) smaller than the carry-on bag
8.2. Excluded Items: Boxes, briefcases, tools, or any items not described in section 8.1 are not included in the standard allowance.
8.3. Overweight Luggage:
- For suitcases weighing over 23 kg, an additional fee will apply as per the current rate listed under "extra baggage or baggage +23 kg" at the time of booking.
- If a passenger has more than one 23 kg suitcase, they must add this as an extra during booking. Failure to do so may result in an additional charge before or after the journey.
8.4. Bicycles:
- A maximum of 4 bicycles per service is allowed at the price listed under extras at the time of booking.
- Bicycles must be properly protected, folded, and in special bicycle transport boxes.
- Bicycles in retail boxes are excluded due to their excessive size.
- Any unusually large box may be rejected, resulting in cancellation subject to the applicable cancellation policy.
- An alternative with additional cost may be offered if possible and agreed upon by both parties.
8.5. Bulky Luggage:
- For bulky items, contact [email protected] before, during, or after booking to describe the object.
- We will assess and offer an adapted rate. If an agreement cannot be reached or the transport is not viable, we will decline the service and process any applicable refund.
8.6. Pets:
- Guide dogs and certified assistance dogs are always permitted and must be declared at the time of booking.
- Other pets may be transported subject to prior confirmation, must travel in a suitable carrier/crate, and availability depends on the vehicle and driver acceptance. Please contact [email protected] to inquire before booking.
- 89 Transfers is not liable for any allergic reactions or discomfort caused to other passengers by approved pet transport.
8.7. Prohibited Items:
- You agree not to include in your luggage any items that contravene Spanish law (e.g., firearms, illegal substances), items that may be harmful to third parties, or items of excessive fragility without proper protection.
8.8. Luggage Damage and Loss:
- Our drivers handle luggage and personal belongings with reasonable care. However, 89 Transfers' liability for loss of or damage to luggage is limited to cases where negligence on our part is proven, and in any event shall not exceed the replacement value of the item up to a maximum of €500 per passenger per booking. We recommend adequate travel insurance for high-value items.
- The passenger is responsible for any costs incurred if additional vehicles are needed to transport undeclared luggage.
8.9. Additional Vehicles:
- If additional vehicles are required due to excess luggage, the passenger will be responsible for the additional costs.
8.10. Right to Refuse:
- 89 Transfers reserves the right to refuse the transport of any luggage that does not comply with these policies or that we deem unsafe or impractical to transport.
8.11. Declaring Extra Luggage:
- To declare extra luggage, please use the "Special Requests" field during the booking process or contact our customer service team at least 24 hours before your scheduled pickup.
9. Child Safety and Child Seat Policy
9.1. Legal Requirements:
In accordance with Spanish law, all children under 135 cm in height must use an appropriate child restraint system when traveling in our vehicles. All children count as passengers and occupy a seat.
9.2. Child Seat Categories:
We offer the following categories of child seats free of charge, subject to availability (must be requested during booking):
- a) Infant seat (Group 0+): For babies from 0 to 13 kg (approximately 0–15 months)
- b) Toddler seat (Group 1): For children from 9 to 18 kg (approximately 9 months to 4 years)
- c) Booster seat (Group 2/3): For children from 15 to 36 kg (approximately 4 to 12 years)
9.3. Capacity Considerations:
All children and infants, regardless of age, will be considered when determining the capacity of the vehicle. They must be included in the total number of passengers at the time of booking. Ensure the vehicle booked is large enough for your group plus any required child seats.
9.4. Booking Child Seats:
- Child seats must be requested at the time of booking, specifying the type and number needed and the approximate age/weight of each child.
- Child seats are offered free of charge.
- Availability cannot be guaranteed for last-minute bookings or if not requested in advance.
9.5. Installation and Responsibility:
- Drivers may assist with child seat installation, but the ultimate responsibility for ensuring the child seat is correctly installed and that the child is properly secured lies with the parent or guardian.
- Parents or guardians must confirm that the child seat is correctly installed before the journey begins.
9.6. Own Child Seats:
- Passengers are welcome to bring and use their own child seats.
- Passengers are fully responsible for the installation and use of their own child seats.
9.7. Multiple Children:
- If traveling with multiple children requiring child seats, please ensure this is clearly communicated during the booking process to ensure the correct vehicle size is allocated.
9.8. Age and Weight Information:
- When booking a child seat, you must provide accurate age and weight information for each child to ensure the appropriate seat is provided.
9.9. Refusal of Service:
- 89 Transfers reserves the right to refuse service if appropriate child seats are not available and the safety of child passengers cannot be ensured. Compliance with child safety regulations is mandatory. Refusal of service in such circumstances may still result in cancellation charges.
9.10. Liability:
- The ultimate responsibility for the child's safety during the journey, including proper installation and use of child seats, lies with the accompanying adult.
9.11. Special Needs:
- If your child has special needs requiring specific seating arrangements, please inform us at the time of booking, and we will do our best to accommodate these requirements.
10. Passenger Responsibilities and Conduct
10.1. Booking Accuracy:
- You are responsible for providing complete and correct information during booking (names, flight details, addresses, contact numbers, number of passengers including children).
- Please review your booking confirmation carefully and contact us immediately if any details are incorrect.
10.2. Travel Documentation:
- You are solely responsible for ensuring you possess all necessary travel documents (passports, visas, etc.). 89 Transfers is not liable for costs incurred due to missing or incorrect documentation.
10.3. Vehicle Damage and Cleaning:
- Passengers are responsible for damage caused to the vehicle interior or exterior through their negligence or intentional misconduct. This includes charges for extraordinary cleaning beyond normal use (e.g., vomiting, significant spills).
- Before any charge is made, we will provide you with photographic evidence and a detailed, itemized report of the damage or cleaning required, along with the proposed amount. You will have 48 hours from receiving this report to dispute the charge. Only after this period, and if no agreement has been reached to the contrary, will we proceed to charge the card used for the booking or request payment by other means. Any disputed charge will be resolved through the dispute resolution process described in Section 18.
10.4. Conduct:
- Passengers are expected to behave respectfully toward the driver and the vehicle.
- The driver reserves the right to deny service or terminate a journey if a passenger is excessively under the influence of alcohol or drugs, poses a threat, or behaves abusively or dangerously. In such cases, a refund will only be issued for the portion of the service not yet rendered, at 89 Transfers' discretion, taking into account the severity of the conduct and any costs already incurred.
- Smoking (including e-cigarettes) and consumption of alcohol, drugs, or illegal substances inside the vehicle are strictly prohibited.
- Eating inside the vehicle is generally discouraged; please check with the driver.
10.5. Repeated Incidents:
- We reserve the right to refuse future bookings from a client who has caused a significant incident or repeated incidents.
10.6. Compliance:
- You agree to comply with all reasonable instructions from the driver regarding vehicle safety and procedures.
11. Communication and Contact
11.1. By making a booking, you consent to be contacted by 89 Transfers regarding your reservation via email, phone, SMS, or WhatsApp using the contact details provided during booking.
11.2. We primarily use email for confirmations and important communications. Please ensure our emails are not blocked by spam filters.
11.3. Both the customer and 89 Transfers acknowledge that email delivery may be affected by various factors, including spam filters. It is the customer's responsibility to check their inbox, including spam or junk folders, for communications from us. If you send an important communication (such as a cancellation or modification request) and do not receive an acknowledgment or response within a reasonable period (e.g., 24 hours for non-urgent matters), please follow up via an alternative contact method (phone or WhatsApp: +34 871 15 36 69) to ensure your communication was received. 89 Transfers cannot be held responsible for failing to act on communications that were not verifiably received.
11.4. You can opt out of marketing communications at any time. Service-related communications will continue for active bookings.
12. Data Protection and Privacy
12.1. We comply with the General Data Protection Regulation (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection.

- Internal record-keeping: Maintaining booking records, invoicing, and accounting.
- Service fulfillment by collaborators: Where necessary to fulfill your booking (e.g., during peak seasons or for special vehicle requests), your booking details may be shared with trusted collaborating operators (see Section 3), who are bound by confidentiality and data protection agreements equivalent to ours.
12.3. We do not sell your data to third parties. Data sharing is limited strictly to the purposes described in section 12.2.
12.4. You have the right to access, rectify, erase, and restrict processing of your personal data. For complete information on how we process your data and your rights, please refer to our Privacy Policy on our website.

14.2. Our services are covered by mandatory civil liability and passenger insurance as required by law.
14.3. Our liability for loss or damage is limited in accordance with applicable Spanish and EU regulations governing passenger transport. We are not liable for delays, cancellations, or failures caused by Force Majeure events (see Section 19) or circumstances beyond our reasonable control (e.g., extreme traffic, road police checks, third-party accidents).
14.4. We are not responsible for missed flights or connections unless the delay is directly attributable to our proven negligence. We recommend booking pickup times with sufficient margin for traffic and airport procedures.
14.5. Liability for personal belongings rests with the passenger (see Section 8.8).
15. Modifications to Terms
15.1. We may update these Terms from time to time. The version applicable to your booking is the one available on our website at the time of booking confirmation. Changes to these Terms will only apply to bookings made after the updated version is published; they will not retroactively alter the conditions of existing confirmed bookings.
15.2. Significant changes to existing policies will be communicated via email or by notice on our website at least 30 days before they take effect.

16.3. Notwithstanding the foregoing, if you are a consumer habitually resident in another EU Member State, you retain the right to bring proceedings in the courts of your country of habitual residence, in accordance with Articles 17–19 of EU Regulation 1215/2012 (Brussels I Recast). Nothing in these Terms shall deprive you of the protection afforded by mandatory consumer-protection provisions of the law of your country of habitual residence.
17. Accessibility and Special Requirements
17.1. 89 Transfers is committed to making its services accessible in accordance with the European Accessibility Act (Directive 2019/882), applicable since 28 June 2025, and relevant Spanish accessibility legislation. 17.4. Providing this information allows us to evaluate feasibility and advise on suitable vehicle options where available. We cannot guarantee accommodation of all requests, but we will make reasonable efforts and will clearly communicate any limitations before you confirm your booking.
17.5. If you encounter any accessibility barriers when using our website, booking system, or services, please contact us at [email protected] so we can assist you and work to resolve the issue.
18. Dispute Resolution
18.1. In the event of any dispute or claim arising from our services, we encourage you to first contact our customer service team at [email protected] to seek a resolution.
